§ 38 free-key (A product from the IT-Innerebner GmbH) Hereinafter referred to as "free-key"

38.3. In order to be able to use free-key, access authorisation must be requested by SMS or e-mail. free-key accepts no liability whatsoever for SMS or e-mails that have not been received and for any damage that may have arisen as a result.

38.4. The network provided functions wirelessly, thus no specific range, transmission speed/ transmission capacity is guaranteed, since this depends in particular on the network utilization, the number of users, the technical conditions of the customer terminal and other circumstances and influences. free-key does not guarantee that the services offered are accessible without interruption and that the desired connections can always be established.

38.6. The user assumes the responsibility for the fact that the end device used by him and the software on it is free of viruses and other malware; the user must fully compensate the operator for any direct or indirect damage caused by violation thereof.

38.7. free-key does not warrant that the use of the hotspot is protected against access by third parties to User data stored on the User's terminal or transmitted by the User in the course of its use.

38.8. The user is not permitted to transfer his hotspot access data to third parties commercially or in any other way against payment; he is also liable for damages caused by unauthorized use of the hotspot by third parties if and to the extent that the user is responsible for such use.

38.9. The customer undertakes to indemnify and hold free-key harmless from and against any and all damages caused by him to third parties.

38.10. With regard to the registered data of the participants, free-key undertakes to comply with data protection and media law provisions, in particular the data will be treated confidentially. The data will not be passed on to third parties. The use of the data by IT-Innerebner GmbH is agreed.

38.11. The minimum age for the use of this offer is 18 years.

38.13. Should any provision of these terms and conditions be or become invalid, the validity of the remaining parts shall not be affected thereby.
